Should I file my taxes this year or not and hoping nothing happens?

Asked by: 44 views Tax Discussion

I wasn’t employed for most of the year of 2011 and most of the year I was getting paid through a 1099. So now I have a form 1099-misc for $ 9676.27 and I also have a w-2 for $ 268.20 state wages with $ 18.74 Federal tax withheld and $ 13.41 State tax withheld. From what I know I’m probably gonna have to pay a lot of tax on the money I made on the 1099 and right now I would have no money to be able to pay tax to them. So I’m thinking I just wont do my taxes and try doing last years 2011 and this years 2012 all together next year and hope that works out. And also hope that I don’t get arrested for tax evasion. But I just heard from a friend that since I was a basically a self contractor that once I factor in write off stuff that I will actually be able to get money back and that I’d be stupid not to file my taxes and get that money. Or maybe he’s just trying to get me arrested to get him Wesley’s autograph. Does anyone have any advise to give? Anybody reading have experience getting paid and filing with a 1099 and what all I had to spend money on throughout the year is able to be factored in and wrote off. Thanks

    You HAVE to file.

You made $ 9944 which is above the filing requirement even if it was all wages. The filing requirement for self-employment income is $ 400.

if you don’t file, the IRS will eventually file for you. They would calculate that you owe $ 1188 for Self employment tax alone. (Since the IRS doesn’t have your receipts, it doesn’t know if you have expenses to deduct.) The IRS would then ADD 22.5% penalty for failing to file by 4/15/2012. Plus 3% interest PLUS .5% per month failure to pay.

Absolutely YES you HAVE to file your taxes, whether you will owe taxes or not!! If you do not file your taxes and you owe the IRS and your state, you will accrue penalties on top of the balance you owe, up to 25% of the amount owed that the IRS will determine based on your income/single/0 exemptions!! This will put you in the highest possible tax bracket! If you file your taxes, you will have some exemptions that you can claim so the amount you owe will be correct, then you can call the IRS, after your return is processed, and set up a payment plan with them so you can take care of your obligation. DO NOT hold those tax forms! You will be doing yourself no good that way!!

file the 1099 on Sch C, your wages on line # 7 and take care of it timely
if you don’t eventually you will be contacted by IRS and if you delay filing, if you owe taxes they will only be bigger by the time you are forced to file, better take care of it now and minimize the damage
1099 income is earned income and can result in some EIC if you qualify, yes, it is possible for refunds

Yes you have to file. You can be fined. No you probably wont be arrested. You are better off to file, and work out some type of payment plan than to skip out all together.

You owe very little if anything in Federal income tax but you do owe Social Security and Medicare tax on the contractor income. It works out to about 12% but there are deductions for a business.

File a Schedule C EZ, Schedule SE to figure the tax and 1040 EZ to see how much you owe.

Ducking this won’t solve it. And the IRS will come after you with penalty and interest if you don’t file and pay up. You can make installments if you can’t pay all at once.
