Please HELP. Can I be kicked out of a home not in my name and I’m disabled?

Asked by: megan 385 views YA Discussion

I am living in my brother’s trailer who only rents it. It was for my Dad who is disabled and for me who is disabled also. My name should be on the lease. Recently, I got an eviction notice from the Landlord who wants me out because I told him I wanted a copy of the lease for SSI. He also said he was raising the rent to 1,000 dollars. We built a new porch for our health and safety and I told the Landlord I had pictures of my Dad falling on the old porch which we removed and Daddy’s arm was a gory mess. I also had fallen on the old porch which hurt my lumbar and bad knees immensely. The landlord said he wanted me out because it sounded like I was “threatening him”. I told him I wasn’t going to sue him. I also have not been served legally by a Deputy and gone to court. Plus, I read about disabled people who rent who modify a home at their own expense for safety can’t have the rent go up. I’m also without a car to search for a place to live. Plus, I have contacted so many Attorneys, Agencies. No go. I have no family to help me. Please help, I will be on the street or living under a bridge if I’m put out. Thank you for your responses in advance.
One day, the john overflowed when I was gone with a friend. I was only in the trailer for 3 days. It was all over the place and the worst mess and smell you ever came across. It was a big job. Stuff was in my hallway, bathroom, bedroom and even in my closet. It was a plumbing problem outside that had been there for a while. I could not have done that in three days. Plus there were paper towels in the mess. I don’t use paper towels! The landlord brought me a small wet vac and made me clean up the mess. It took a long time and hurt my bad, bad back (lumbar) from bending over. I cried the whole time. Now then, it you think this was okay for a disabled person to do please be more compassionate. At the top, why does ‘ show on my question?? I don’t curse and my fingers don’t either.

    You heard some incorrect things.

Nothing prevents rent from going up. It is also illegal to discriminate based on disability, so you can’t use that to prevent eviction, you have to, by law, be treated just like everyone else.

Since you are not on the lease you can be evicted simply for not leaving when told to, you have no rights to live there.

Not having a car has northing to do with an evictionn.

SSI does not need copies of a lease you do not have, so yes, you were acting oddly asking for that.

Pay the new rent and see if you can work out other differences in order to stay.
