IRS timeframe for issuing refund after the issue of a CP 05 letter?

Asked by: samserio 11667 views YA Discussion

The IRS has had my 2011 return since Jan 22. After not getting my refund, which is substantial.. I started to get worried. I called the IRS and was told I would get a letter about my return. CP 05
They needed to review the info on my W-2. They sent the letter Feb 6th ..I got it Feb17th and it is DATED Feb 27th..(WTF???) so of course the 45 days starts from the date on the letter not when they sent it. Which I find to be rather like cheating. 2 weeks ago we got a call at work from the IRS wanting to talk to our corporate accountant. She called them back and verified everything that was on my W-2..(which matched to the penny I might add.) They did not ask her for any additional documentation nor have the asked me for any additional documentation. I called the IRS yesterday and inquired about the status of my refund. A very nice lady informed me that there would not be a resolution until the 45 days on the CP 05 letter had passed. I told her it was unfair since all the questions had been answered by the accountant, and they should do what is right and give me back the money they owe me. She was very understanding and made notes on my call. I find it ludicrous that they are able to hold peoples money AFTER they have the answers to their questions.
If we taxpayers owe them a dollar they want it right now..Ironically I got my state refund in 4 business days.

The budget for the IRS was cut this year. The backlog of responses to be evaluated is enormous.

Yet, you think that your refund is more important than anyone else who is in the same boat you are.

Look, the IRS doesn’t even get most W-2s until May. They apparently believed your tax return was legitimate enough to actually call your employer rather than wait until May. Even if the IRS had released your refund the same day they called, it can take 3 weeks to get the refund check issued. (The IRS computer system was designed in the 1960s and very little of it is real time.) In all likelihood, the person is spending a week calling employers, then spending another week inputting all the commands into the computer.

When you called in, presumably the tollfree assistor looked at the account and didn’t see the release. Thus they had to resort to saying, sorry, it can take the full 45 days.

BTW, if your refund is solely because of withholding on your W-2, why did you have so much withheld? If you were expecting to owe and then didn’t, fine. Life happens. If this is the first year you have worked for this employer, yeah, that happens too. But if nothing changed and you intentionally had this much withheld so you could get a big refund, you did this to yourself.

Your refund is not late until June. So be patient.

“Ironically I got my state refund in 4 business days.” – irrelevant b/c state and federal taxes are entirely unrelated.

I agree with the other posters. Considering you apparently already have a campus agent actively working your return this early in the tax season, you should consider yourself very lucky. Many will not get this kind of issue resolved until June or July.

I agree with crzdgrl, this is very frustrating, samserio was just venting like everyone else. My return was accepted on 24 Jan and I can’t get any help from the IRS or a Tax Advocate. I can guarantee if you owe them money, they’ll find a way to get their money. I wonder how many IRS employees got their returns?
