I think my income tax refund will be offset?

Asked by: jmlcpl 1514 views YA Discussion

After I filed our income taxes (Feb 3rd) I found out that due to my husband’s defaulted student loans our refund may be offset. Shoud I go ahead and file an injured spouse form or wait to receive a notice from the IRS?
I did check the offset phone number and before I filed, it said he had no debts. He had been paying on the loan rehabilitation plan, but we got behind due to circumstances. We didn’t receive a notice of the offset this year, so we didn’t think it would be taken. I checked the number again today and of course, now it says he has one debt… the student loans. I know we need to pay the debt, but with one income and two kids, we could really use the money.

I’d just start paying the student loans.

Since you didn’t file with your tax return, might as well wait for IRS notice
Can call the IRS Offset line to find out whether it will be offset
This debt will follow you until it is paid. . .only defaulted, delinquent student loans offset refund
Having a payment plan, obtaining a deferment, both prevent your problem, as well as being the responsible way to proceed
The Offset program is a way the IRS helps taxpayers meet their legal obligations

The past due loan amounts will HAVE to be paid in the future and failing to do so NOW will only make the past due amount larger in your future life time for this purpose.
So why NOT just leave it alone and let them REDUCE the past due loan amount by the REFUND amount for this purpose and get started paying the loan amount off to get it cleared out of the way at this time in your life.
Hope that you find the above enclosed information useful. 02/19/2012

Pardon my honesty but it is people like you that have me out of the income tax profession for good.

Did the IRS make you have a child and run up student loans and get into financial problems? No the IRS did not do that. But the IRS has to clean up the mess by hiring employees to run the offset program. The rest of us pay for that. The lender who lent your husband money to go to college could use the money too.
