CO Resident Charged 10% Sales Tax on Online Purchase from CA?

Asked by: 54 views Tax Discussion

I recently bought an item from Acer Computers online and was charged more than 10% sales tax! I understand CA has a new online sales tax, but from what I read, that’s for CA residents buying something from their state, not someone from out of state. 10% tax is way too much anyway! I can’t find any definite answer to what tax I should be charged. I believe I should be charged the tax from where I live (4.3%) at the most. All of my questions to Acer have been answered with complete gibberish by their overseas tech support team. Can anyone tell me what the truth is about what tax I should have been charged? Thanks!
So what’s the tax rate now? I bought this item last week. There’s no way I should be charged 10% under any circumstances!
I just got an answer from California’s Board of Equalization. They said, “If the items are being shipped by common carrier to you by your vendor out-of-state for use out-of-state, then generally they are not subject to CA sales tax. For additional information, I’ve provided you a link to Pub. 101, “Sales Delivered Outside California”. http://www.boe.ca.gov/pdf/pub101.pdf ” Now I just have to get my money back from Acer!

it sounds like the nexus for ACer is one of the communities which has an additional tax that did not expire June 30
as of 7/1/11, Calif. sales tax is 7.75% but in some communities it is 8.25%, prior to that date add 1%
