Can you claim a child with no SSN?

Asked by: minchk 440 views YA Discussion

Short version is my friend’s son has no SSN. Hospital never sent paperwork, then when she did the paperwork, it got messed up, more to it, but that’s the short version. He’s only 5 months old.
She wants to know if she can still claim him.
I have no idea.
She doesn’t have the birth certificate (part of the whole “long story” thing). She does have hospital papers, wellness visits, so on.
Still yes, or no?
Whoa, folks, don’t shoot the messenger. ;)
I’ll just pass the message along.

Yes, she can claim him, but she MUST have a SSN for him BEFORE she files her tax return. Without a SSN for her son, she cannot claim him as a dependent.

She can get an SSN now. And you absolutely need one to file a dependant claim on your taxes. You don’t need the actual card–take the baby’s birth certificate to the SSN office nearest you and fill out the application and tell them you need it for your taxes. They will give you a NUMI (number issued form) with a number–and you can use that. Remember–you have until April 15 to file your taxes–so there’s plenty of time.

    No SSN, no claim.

The last time the IRS made an exception was for Hurricane Katrina victims in 2005.

She can file an amended return until 4/15/2016 and claim him.

PS, the longer she waits, the harder it will be to get this straightened out. Without an SSN, the entire US is going to think that child is an illegal alien.

If she has no birth certificate, she goes back to the hospital and gets in their face. What did she do, forget to name him?

Long store short – she needs to get a ss# for him. Something sounds real fishy about this story – hospitals fill out the paperwork before you leave when the baby’s born, they don’t just mail it to you.

But that aside, no she can’t claim him without a ss#. And she needs to take care of this, before not having one causes her AND him trouble in the future.
